Seller cancelled my BIN transaction but I wasn't the last person to buy (selling 5 of the same item)

Wonder if someone can help me....

 

On Wednesday last week I bought, & immediatly paid for a, BIN item - the seller had 5 of the same item, 3 had already sold and I bought the 4th. I bought my item after accepting an offer from seller, the other buyers didn't (this may be relevant).

 

Over night I have received an e-mail from ebay to say the seller has cancelled the transaction with a generic 'Item is out of stock/has been damaged' as the reason. I have been into the listing this morning and only my transaction has been cancelled, as I said above, all others bought at the original price including the person who bought the last unit after me.

 

Can I report the seller to ebay as it's clear they picked the person who paid least to have their transaction cancalled as apposed to the last person to buy? I assume, under these circumstances, I can also leave feedback to relfect my experience?

Once you have made payment for the item it is your own property from that point onwards, so if something really had gone wrong, such as the item being damaged, destroyed, lost or stolen, then the seller should have sent you an e-mail via eBay Messages to explain the situation to you and apologising for the inconvenience caused.  At that point he should have let you know that he was going to refund your money in full, which may have helped to limit the disappointment that you felt.  If he had done that then he may have been able to reduce the risk to some extent that you'd leave him negative feedback, but given that the seller has failed to be honest with you I'd advise you to leave him the negative feedback that he deserves.  Just make sure that it doesn't include anything that could end up with the feedback being removed - words such as "Conman", "Scammer", and "Thief" would all increase the chances of the feedback being removed so just keep it short and factual.  Something such as "Paid in full immediately but seller failed to send the item" ought to stick and would serve as a warning to other potential customers who were considering buying anything from this seller but had decided to check his feedback from other buyers first.
