Purchased an item and the package arrived opened with nothing inside ?

Hello,

So i purchased an item for £300 and upon receipt of the padded envelope, there is a large cute in the side and the item has been taken out.

I knew this was a gamble when purchasing as the ebay account had feedback saying an item didnt arrive and the seller is selling the exact same item. I quireid him on it but he said he had two of them.

I dont want to mark it as ''hasnt arrived'' because tracking shows it has, so what should i do ?

I have spoke to him and he says he will contact hermes.

Open ebay case for ITEM NOT AS DESCRIBED,

seller provides returns label, you post envelope back for full refund,

if no label or refund escalate to ebay 3 working days after opening case.

You don't have to wait for seller to sort with Hermes.

Youshould have refused delivery or at least signed the carriers document that it was damaged, open, and no contents. If no signature was required, you will have no case AFAIK.

This is incorrect reply.
OP must NOT refuse parcel,
correct way is to open ebay case for not as described, seller provides returns label & refunds in full on return.
