Hi I've received a pair of trainers stated as new, but they've been worn and there dirty and worn

I've received a pair of trainers listed as new in box but they've been worn with dirt on the soles, toe boxes are crumpled and they've left dirty socks inside and are denying they've done it, also stating I've worn the trainers, which I haven't. Why can I only ask them to accept a return and not as described thanks

I'm not sure I understand what you're asking. All you have to do is open a return request, choosing not-as-described from the list Ebay presents to you.  The seller must then 'accept' the return, which will trigger a prepaid and tracked returns label at the seller's expense.  If they don't do so within the stated timescale, escalate the return request to Ebay, and they will force a refund without the need for return.

 

I doubt this is the seller's doing, as such an action will cost them dear.  It's more likely that the trainers were switched in transit. But that isn't your concern.  The seller must refund in full as required, and then lodge a claim with the carrier.
