Seller has offered a partial refund which I have agreed to but he states that I have to close the case first as per ebay's rules...is this true?

There is a problem, seller can only make a full refund, he cannot make a partial refund.
If you close the case there is then no way to enforce the partial "agreed refund" and promises are too easily broken.

It is all very well saying get your refund first, it just isn't possible unless the above procedure is folloowed.
