Can I get a refund for item which later broke?

I wonder if anyone could help?

 

I recently purchased a car splitter through ebay - item arrived promptly and was in good condition as described. I fitted the part over the weekend using the screws and tape provided but when I then drove the car, I heard the splitter drag along the road. After checking, the splitter was still in place but the front hanging low. I am confident that I fitted the splitter correctly and believe that the screws provided were strong enough to hold the splitter in place, therefore causing the front to drop.

 

After then contacting the seller and reading the seller reviews, I noticed that some buyers have also disputed the quality of the goods recieved (which I originally missed) and noted that other sellers provide bolts instead of screws when selling this product so I am certain that the fault lies with the screws supplied. I emailed the seller to explain that I was not satisified with the parts and would either like a refund or a replacement part. However, their response was that the parts only fail due to incorrect fitting and they would not accept a return nor give a refund for the part.

 

Please can anyone advise what I should do next.

For a not as described case, you are expected to return the item in the same condition as received!

But what is "recently"?? PLEASE give exact dates when asking questions. Your rights on eBay depend entirely on the date your item was delivered.

 

As you've been told, you can still use eBay's money back guarantee, if within the 30 day time limit.

 

If you get your money back, think yourself lucky. EBay doesn't warrant the quality or items sold here, or even that they will be fit for purpose. The fact that this may have been a flimsy, badly made product doesn't mean that it wasn't as described, which is the only grounds for a refund.

 

Luckily for you, eBay usually take the buyer's word for this without asking any questions. From day 31 after delivery, eBay gives buyers no suupport, whatever is wrong with the item. Keep this in mind when buying here.

You have 30 days from Delivery to open an Item Not As Described Case with Ebay. Read the Ebay Money Back Guarantee is on every Listing Page. Seller will have to issue a Returns Label through the Case. Escalate the Case for Ebay to Step in on day 9 - 21
