item not received

Hi I recently purchased a item and didn't receive it.I contacted the seller and he replied by saying that he would send another item out but like the first time I didn't receive this one either,I opened a case against him but as he said he was going to send a 2nd item I closed the case in good faith.I'm still waiting and it's been 4 weeks now and I can't seem to get a refund can anyone help as to what I should do next.

By closing the case you have thrown away your right to a refund under eBay's money back guarantee. You can't reopen it now.

 

The better news is that you can still open a case under PayPal's longer, 180 day buyer protection policy.
