buyer refusing me a refund

hi can anyone help I have asked my seller for a refund as it was discribed as brand new when it arrived it is all marked they are refusing to refund me ,i have requested a return and i trying to get ebay to step in and help how do I do that as it keeps saying I cant as I have requested a return anyone please

I assume that you have opened a case for 'item not-as-described' - just wait for 8 full days and then you will be able to ask eBay to step in.  The option will not appear any earlier and the timing is to the second that the case was opened.
