I opened an unpaid item case on 25th Jan and now am unsure what to do.its pretty obvious I'm not going to receive my money from the buyer but do I need to wait for eBay to contact me to allow me to relist the item.

You need to go to the resolution center and close the case, ebay don't contact you.
Once you have closed the case you will get the final value fee credited to your account and you can relist the item.
