A buyer advertised a laptop taken out the box and and when I started useing it had problems with the screen and keyboard and took it to apple who said it was registered in xxx and I brought it in xxx , he can't have left it out the box for 9 months without using it , BUT the CLOSED THE CASE WAS CLOSED NO REFUND

I presume you mean seller & not buyer.
What type of case did you open?

I opened a case that the item was not as described and had proof , the seller said box open apple Mac never used , I found stuff on the hard drive from a year ago , which I have got pictures of , but no explanation eBay or the buyer just closed the case and when I emailed eBay they says the case was closed

If you opened a case for item not as described the only way the case would close immediately is if you opened it too late. You have 30 days from the item's last estimated date for delivery to open the case.
If this time has lapsed, turn now to your payment provider for help with your refund.
If PayPal was used to pay, they have a 180 day buyer protection policy.
