Ebay remove listing relying upon false information and lies.

Hi All,

My listings were removed based upon lies by ebay. They claim my item was counterfeit and have been reported by Microsoft. I contacted Microsoft who have denied removal of my listing (I have email proof). I contacted ebay again and they said ask Microsoft to contact us which they have already done (again I have email from Microsoft which shows they made contact).

Ebay again is not sorting the issue out and still saying I broke policy and cant even prove it.  The item I am selling was PC hardware driver install DVD which is freely available under GNU license and allowed to be complies and distributed. Currently 1000s are being sold on ebay.

I have already contacted trading standards who are looking into my case. I really don’t know what to do. As it seems I’m going round in a circle with ebay staff who just send me automated screen scripts.

Any advice on who can deal with this matter as I really can’t waste any more time with ebay?

Ebay's hands are tied. When a brand owner contacts them to say a particular item is counterfeit, they have to remove the listing - it's the law.  You can read all about the VeRO programme for yourself (link at foot of any page).  When that happens, it is up to you to counter that claim with the brand owner. If, as you say, Microsoft say they lodged no such claim via the VeRO programme, then it is up to Microsoft to advise Ebay accordingly. You say that Microsoft say they've done that, so you will just have to wait for things to take their course.  You don't say how long this has been going on, but it won't happen quickly, obviously, as Ebay will have a mountain of similar stuff to work their way through.

That there are similar items listed on Ebay is totally irrelevant. The brand owner has to report each listing separately. And as soon as a batch of such listings are removed, another batch appears. It's a never-ending task.
