If it is over 30 days past the item's last estimated date for delivery they cannot open am eBay case .
Paypal do have a 180 day policy but usually held for item's not received. If they did try and claim from them Payal do investigate further than eBay, will probably ask why this fauly was not found before, and why tags removed etc, there also, buyer has to pay for a fully tracked return postage to send the item back to you.
