Buyer had the item 3 weeks before telling me it was broken , where do l stand
Buyer has 30 days to open a Not As Described Case,if he does then you provide a reply paid label and on return you refund in full.
If you don't want a broken item back then you just refund through the case.
Unless the buyer opens a case you need do nothing, as refunds are only made through the systems provided by ebay then you at least get the selling fee refunded.
Once a case is opened, if you argue the buyer escalates to ebay who will refund at your expense BUT you do not get the fee refunded and you do get a defect.
You should really read the Money Back Guarantee to see what it is all about. It favours the buyer every time.
In addition to what has already been said, if you do ask for the item back as a condition of issuing a refund then issue the buyer with an eBay returns label. If the buyer returns the item to you and it becomes clear that the item has either been damaged by the buyer, or is not the same item that you sent to the buyer, then report the buyer to eBay for misuse of the eBay Money Back Guarantee. You would more than likely have to issue the refund anyway in order to avoid a defect on your account via a forced refund, but at least if you reported the buyer to eBay it would flag his/her account up to them so that if there were any similar reports from other sellers of that type of behaviour then eBay may well take action against the buyer. If they did decide to do something as a result of a worryingly high number of similar reports then the buyer could either end up with his/her use of the eBay Money Back Guarantee being restricted, or in very extreme cases, eBay may decide to close the buyer's account and chuck him/her off of the site for good.
