Seller copied my photos and descriptions

Hi everyone,

I saw the other day a seller is using my photos. When I scrolled down a bit, I also saw the description was copied too. The funny part, the seller is even using the link that directs to main page of store from my description. I directly reported to seller, as before when I tried to contacted with the sellers, I received really rude messages. Anyway, eBay just responded now and here is the response;

We appreciate you bringing this to our attention and are sorry to hear that you have found a seller on the site that you feel is using your photos without permission. We realize the content you use in your listings is very important to you and that it takes time to create it.

I understand it can be frustrating when eBay is unable to take action when you report sellers or listings. I’d like to further clarify for you why eBay is unable to accommodate your request.

We do not take action on reports where images and/or text are copied from one eBay listing and used in another as described in eBay's User Agreement. When uploading content to the site, sellers grant eBay the right to that content and waive the right to enforce infringements related to that content.

So, shall I not use my brain to write a descripton and steal the photos from somebody else from now on? I don't know why eBay is not taking action, when there is a page specifically for this reason.

My eBay item number: 392623533137

Copy-paste one: eBay item number: 333756372051

Thanks!
