I have asked non payer to settle invoice but no reply or payment. Can I second offer to runner up in auction and how long do I have to wait to do this

No, you cant, or you could end up with two buyers for the same item.
Plus, you'll have to pay Ebay two lots of selling fees, even if only one of the buyers pays (the selling fee is applied the second an auction is won or an item sold).
You must open an Unpaid Item case, and close as 'unpaid' after 4 full days to get the selling fee credited back to your Ebay account. That will also give the buyer a deserved Unpaid Item strike on their account. You'll then be free to safely relist.
Also, add the non-payers Ebay ID to your Blocked Bidders List so s/he can't mess you around again. And tighten up your Buyer Requirements (Account...Site Preferences), paying particular attention to the one which blocks buyers with 2+ Unpaid Item strikes in 12 months.

If you want to get the selling fee refunded you must complete an Unpaid case and only when close is it safe to relist or make a SCO.
An unpaid case gives the buyer 4 days to pay so if you sold again, two lots of selling fees, two buyers, one item, a recipe for bad feedback. When an item sells ebay sends an invoice, buyer then has two days to pay,on day 3 ebay end a reminder.
There is no need for you to send an invoice or message the buyer, you can just open an unpaid case. It is a good idea to put on your listing "Please pay within two days".
