Claim With Packlink and UPS a strange story

This is a strange story but i dont know what to do. I sold an expensicve antique drill that had seized up and been kicking around my garage for years i have knocked it over several times never a problem solid bit of kit anyway i sent it UPS and paid for total amount compensation gets to buyer and he says the arm has broken off so amazed at this i asked for pictures of  the packaging and low and behold there was a hole punched in the side with a picture of the broken arm or handle now my first thought was he has tried to force it as it is seized(described in the details) i went down the insurance route with UPS via Packlink and UPS now have come back 2 weeks later and say they want the packaging and the drill for examination This is where it gets a bit funny the buyer has disposed of the packaging and he has been taking the drill apart so he says they cant have it ? I said that they  probably wont pay anything now but he wants me to give him a partial refund for the broken arm if they dont. If i dont he will probably open a case with ebay so i dont know what to do Do you think Packling would back me up with EDbay as i think the buyer is acting very mysteriously Why would you dispose of the packaging and start stripping down the drill ? I am not sure where i stand with this Any help would be appreciated if you havent fallen asleep by now \sorry for the long tale Thanks  PS if you look at my feedback you will see how much effort i put into packing things.

To help prevent the reader falling asleep it is good to put in sentences and separate with white space.

The sad thing is that if the buyer opens a case for not as described then eBay almost always finds for the buyer.  They have no way to examine anything and have no wish - for example - to read reports or look at photos. 

 

In theory you should not have to refund as the item should be returned [at your cost] in the same state as when it was send.  But as I say, this is the practical advice about eBay! 

 

You send the label to return [if it's really worth it] and refund when it comes back. You might then be able to appeal but the chance is not good even less so perhaps with staff/Covid problems

As arkwebus says, if the buyer opens a case, YOU HAVE to pay for a return label and on return, refund in full.

 

This where the problems come in. Is it worth paying for return of something that is broken, but if you don't then buyer gets away with it.

 

Item is also supposed to be returned in the same state as received. Obviously that is going to be impossible, BUT ebay do not know, they have never seen the item, before or after receipt by buyer, so buyer can get away with murder and return anything they like.

 

It is your choice, but if buyer escalates ebay will refund and possibly not even bother with wanting return first. You still pay the selling fee and get a defect.

 

 It is up to you to perhaps call the buyers bluff and hope they do nothing, if you supply a return label you only get charged if it is used.
