Basically, i'm selling Hilfiger tops and sold more thn 100 (got 200 positive feedbacks %100), but couple days ago a buyer accused me of selling fake and asked me free return label. And i asked her do you have any proof that my item is fake, she sent me her another hilfiger tops which are completely different patterns.(she doesnt even know hilfiger different style tops or she just doing this on purpose otherwise she cant be that much silly) I explained her everything but she didnt agree and left negative feedbacks. I applied to remove feedbacks but they didnt. I contacted ebay customer asistant as well, but nobody helping me. Its unfair, she doesnt have any proof, she just got different style tops and blaming my tops as fake. Is it that much easy to blame someones items as fake ? And Ebay doing nothing about that ?
so if i buy a tshirt and if i dont like it and dont wanna pay for a return label, shall i accuse seller of selling fake ? and get free label. (ebay customer asistant kept telling me to pay her label, otherwise they will do it on behalf me)
Could you please help me ? What should i do ?
Many Thanks
I'm afraid you don’t have a legal leg to stand on, as you're trading illegally on a private account. Consumer law states that a buyer can request a full refund from an illegally-trading seller for any reason at all, for up to 1 full year and 30 days, and the trader has to pay their return costs too if they want the item back. And it can be returned in any condition whatosever. In other words, your customers can use you as a free hire shop. The law doesn't reward those who break it.
Anyone who makes, grows, refurbishes, or buys in (new or used) items to sell, is a business and must be registered as such. Not only an Ebay requirement but the law. Private accounts are ONLY for those selling off their old no-longer-wanted possessions from wardrobe and attic. That clearly isn't you. For confirmation, go to Ebay's Seller Centre (link at foot of any page). For full information, go to the government's website.
And note that there is no such thing as a 'hobby seller' in this country, and how much or how little you sell or make is totally irrelevant.
Most buyers are savvy these days. Yours may be one of them, and may already have reported you, to Ebay for defrauding them of fees, and to Trading Standards for denying buyers their legal rights. So my advice is that you do as legally required of an illegally trading seller (pay for the return, or refund in full without the need for return), and get your act together and upgrade your account from private to business as matter of extreme urgency, before you find yourself in the deepest of deep doodoo.
You have one big problem at the moment which could get a lot worse.
You have admitted to the world you have sold over 100 tops and another responder has highlighted the fact you are trading as a unregistered business seller.
That means any of your buyers have a full legal right to return there purchase for upto 12 months after buying and you having to refund in full.
And it can get a lot worse.
Your buyer has made a accusation of the item been fake.
Should they pass it on to trading standards that could result in prosecution, and a fine, and a investigation into all of your stock.
It's so easy to register as a business seller and could save you a lot of hassle.
My advice is bend over backwards to help this buyer, don't make waves with eBay, and register your account correctly
it could possibly someone who objects to you trading on a private account
ebay won't remome the feedbacks
you need to Upgrade to a Business Account
It is unfortunate but you have no option other than to accept the return or ebay will do it for you. It is just part of selling on ebay. Check it is the item you sold and in the same condition. You Can report the buyer if you want. I would get the item back so that i can relist it and sell it again. Some buyers are well aware of how to get an item returned without having to pay for postage, thankfully these buyers buyers are in the minority.
