I posted some gold item on ebay by using RM guaranteed special delivery .The delivery was delayed and buyet opened case and ebay closed case with refund .However the item was delivered with proof of signature and a picture next day  after the case was closed in favour of buyer . So i am continuesly asking buyer to return my item but buyer is refusing that she didnt receive the item .However i claimed RM they saying gps tracking shows its delivered to the buyers address.what should i do

Send the buyer a 'letter before action' as advised.  You will find a template online.

Send it using a signed for service - a letter will have more impact than a Whatsapp message.

If it was the item you sold for £5000, then you should take this seriously, maybe consult a solicitor, and be prepared to take legal action against the buyer.  If you want your money back, you must be pro-active.

You're outside of any help from eBay now, this would be between you and your buyer.

 

If you have RM Special Delivery proof of receipt and the tracking shows delivery to the address in the order details then you may want to pursue this via a legal claim.

 

Out of interest, how delayed was the package? Only because a buyer can't open an eBay item not received claim until after the latest estimated delivery date on the order has passed, and they then have to wait an additional 3 business days before they can escalate it to get a refund.

If the delay might have been caused by the winter weather ebay are supposed to be protecting sellers in those instances.     I would try to speak to someone at ebay about this.   Click on the help link at the top of any page.  Select any topic then scroll down to Contact Us and get to automated assistant.   Ask to speak to an agent and repeat until it passes you to a real person.

You need to report this to Action Fraud and they will issue you with a case number.

Inform the buyer that you have reported it.

Download the evidence from RM, GPS proof and photo of the signature plus the tracking info.

Contact Ebay CS when you have all of this information.

Did you respond to the INR case when it was opened and enter the tracking number?

Did you buy the Special Delivery label through Ebay or direct from the Post Office?

If you bought through Ebay, the buyer was refunded and the item was subsequently delivered, Ebay will repay you.

Otherwise, you will have to keep on at the buyer to either return the item or repay you.

If you have definite proof of delivery to the address they used at checkout, you may be able to make a legal claim using money claim online.

That would only apply if the OP issued the refund themselves.  From their opening post it sounds as though eBay had to step in and issue the refund.

You are right - unless the OP refunded the buyer and bought the label through Ebay that doesn't apply.

You need to send the customer a "letter before action" and after a suitable period, you can then use the small claims procedure to pursue them.

 

You are not going to get very far with Ebay I think.  Though you should have the option to appeal if this went to a case.  Have you actually appealed it?

I bought label from ebay and ebay refunded the money .i contacted ebay several times they saying you got account restrictions we cannot help much but they send me an email by uploading some documents for removing the restrictions i have done already but have not heard anythinh from ebay

Instead of letter i sent watsapp messages to buyer for the same .Also i tried to appeal ebay cancelled my appeal said you have account restrictions.

Sorry, not done this for a while, but didn't there use to be an appeal button, where you for a certain number of days (30 ?) could 'appeal' the decision by ebay, for scenarios such as this. (ie The item has now been delivered). Or has that been removed now ?

I already did thay option they cancelled the appeal amd said decision is in buyers favour .I have no idea what is the sellers protection for ebay now

   That is strange, I suggest actually talking to ebay customer services again and persisting with it. Sometimes you just need the right rep. The fact is, you can now prove successful delivery of your item, that was the point of the appeal process. There has been a change in the status quo since they ruled on it. They cannot deny your item has been delivered to the buyer. I know in the past, others in similar situations, have been successful. Especially if it was ebay that chose to refund the money, not you. That means you never initiated the refund, nor accepted that as solution. Again, I'd persist and a solicitor may suggest action against all the parties involved. It may be the value of the item that has ebay reluctant to change their position.

Ebay only reverse refunds, or do a courtesy refund to the seller, in very exceptional circumstances. 

 

For example, delivery refund reversal need the seller to have bought the postage through ebay.
