If your refund doesn't arrive as promised and the order delivery date given is passed, open a 'Not Received' case > Escalate case to eBay after 4 complete days for a full refund --- >

The seller should really have refunded once they knew you weren't going to receive the item; especially as it sounds like they don't have an identical item to send out. However, you are covered by eBay's Money Back Guarantee - you can open an "item not received" dispute the day after the latest estimated delivery date eBay gave you. If the seller hasn't refunded by the third business day after the case has been opened you can escalate the case and be guaranteed a full refund.
