If I buy a product like a motherboard that is listed as open but unused and I get it a bench test it and it dont work. do I have the rights to a full refund as not fit for perpose?

Yes,  "no returns" can only ever apply to "change of mind" returns,  not when the item is not described correctly, for whatever reason.   Even private sellers have to give refunds then.

I also seen on the consumer right that private sellers don't have too issue refund on item even if not fit for perpose

You are trying to over-think this.

 

eBay's money back guarantee is separate from and in addition to you  legal rights. Legal rights are often meaningless or unenforceable on eBay anyway, even when they apply.

 

eBay's money back guarantee gives very good protection - too good, many sellers would say,. EBay takes the buyer's word without ever seeing the item that it does not match the description, and is consequently widely abused.

 

But don't forget the 30 day time limit. From day 31 eBay will have no interest, whatever happens.
