faulty phone

i bought a cheap phone for my daughter which was a Apple iPhone 5S 32GB Unlocked Silver Boxed Matching Serial Numbers

in total including postage it came to £21.45

the phone didnt work and after trying to recharge it for 24hours, it still hadnt charged.

although the seller stated no returns, because it is faulty I thought I could return it.

after contacting the seller he said I could send it back but I would only get my money back if he managed to resell it for the price I paid for it. If I return the phone to him it means not only has he got the phone back, but still has my money (I think I paid £18.04 for the phone)

can he do this, he might never sell it again so I would lose my money. I wouldnt expect the postage back but if he has the phone am I not entitled to the actual amount I paid for the phone it self.. thank you

No,  he cannot do this,  and yes you can return the item for a Full refund,  if you do so within 30 days of the item's last estimated date for delivery.

 

Ignore any more messages from this seller , do not answer them,  but proceed this way:

You have received an item not as described,  go right of the item in your Purchase History and from More Actions select... Return this item selecting the reason Item Does Not Match Description or Photos.

 

The seller needs to accept this case within 3 days and refund,  if they want their item back first , they need to pay for that fully tracked return postage, then on receipt of their item they have 48 hours to refund you.  If they don't ,  need to escalate the case,  ask eBay to step in, and they'll force the refund.

 

Never listen to any excuse or promise from the seller to close the case early,  and do not forget to escalate.
