On December 26th, I ordered a smartphone. Two days later, I received an email notification that my package was on its way. On the evening of December 30th, I returned from work and found some purple container. I also received a message about the smartphone's delivery. Instead of the smartphone, there was a regular charger, nothing else. I immediately wrote to the seller and to you that I hadn't received the product, that it was a scam; only the charger had arrived, but no phone, and the email said the phone had arrived and the order had been delivered. I was told the phone might arrive later. To wait a bit. Today, it arrived unopened, without the original packaging. On the phone screen itself, there was a hand-applied sticker covered in pimples. This suggests that someone else had already used this phone. When I ordered this phone, I immediately wrote to the seller that if everything was in the original packaging, I would send it back. If not, I would not order it. He said everything was original. Now I want to return this defective product, but the system shows I received it on December 30th, even though that wasn't the case, and I can't open a dispute yet. Why can't I open a dispute and get my money back? I ask this arrogant person, who should be jailed for harassing customers like this, to urgently investigate this matter and send me a return label for his terrible phone.

select "Item doesn't match description" and escalate it to eBay after 3 complete working days.

You don't need to communicate with the seller any more.

Just wait until you are able to open a return which should only be a day or two.

The seller will have to supply a label and you can return everything you have received.

Hello, I'd like to clarify the situation with my phone. Let me start by
saying that this seller immediately started acting dishonestly. Before
ordering, I wrote to him: "If you have any phones in stock that have never
been unpacked, with factory labels and in their original packaging, and if
so, I'll buy them from you." He immediately replied that he did have some
in stock, and we could confidently order the phone for him; this can be
verified through correspondence. Then, big problems started at the
beginning of the thirtieth: instead of the phone, an envelope with a
charger arrived, and I received a message about the delivery of the goods.
I immediately wrote to him: "What's this joke? Where's my phone?" He
replied: "It might have gotten lost in transit because he sent everything
together." You wrote to me that I would also wait, that the goods were
supposed to arrive. The goods arrived very late. As soon as the postman
handed it to me, I immediately took a photo of the box, which shows that it

product—that's their personal problem. As you know, in addition to consumer
protection, I can return the product within a month, even if I've used it,
and I'm guaranteed a refund. Furthermore, you guarantee a mandatory refund,
so if I don't receive the money soon, I'll file a lawsuit. I trust your

I appreciate that you've tried to give us the fullest possible explanation, but all that really matters is the date that you received anything from this seller - even if was only a charger, when it was suposed to be a phone.

 

You told us that this was delivered on 30th December. eBay's money back guarantee only lasts for 30 days from the date of delivery. Unfortunately, unless you have already opened a case under the money back guarantee it will be too late to do so now. eBay will not get involved.

 

How did you pay for it? Your payment provider for example credit or debit card issuer may still be able to help.

 

Otherwise any claim you now have is against the seller. If you're talking about legal action I suggest you start by talking to Citizens Advice, who may be able to suggest whether you have any realistic prospect of success.

You have 30 days from the date of delivery of the charger to open a return case using a 'not as described' reason.
