the seller has now immitted they made a mistake on the listing but how can I get refunded?

If the seller is no longer able to sell you their item, ask them to cancel the order as this will fully refund you.

 

eBay will notify you when the refund has been made, and it will go back to original payment source.  If you paid by credit card,  it can take up to 30 days to appear back in that card account.

 

If for whatever reason the seller is not cancelling the order,  you will have to wait one day after the item's last estimated date for delivery and open a case for item not received.  If the seller does not refund within 3 days through the case details,  you escalate on day 4,  eBay step in and force the refund.

 

You can leave appropriate feedback if you wish, as to how this transaction concluded.

Thanks for the reply but I've had delivery and they are not the correct
size and the seller won't refund eBay has cancelled my request but the
seller has now admitted their mistake but I'm out of pocket and no
trainers!!!

It looks as if you opened a return stating that the shoes were the wrong size or did not fit so the seller was able to refuse the return and the case closed.

You can't reopen the case or open another case.

You can try to negotiate a return with the seller without involving Ebay, or you could try your payment provider.

You should be able to start a chargeback on the grounds that the item you bought was not as described.
