Hi, I purchased a Jellycat item on ebay advertised as bnwt and has an authentic label. I have now received a message from seller. They said they had now sold all the labelled new with tags Jellycats and only have unlabelled ones left. They asked if it was still ok to send to me but obviously I said no!
They have put it through as buyer refunded due to incorrect address.
Is this something that needs reporting or are they not breaking any rules.

Seller should have used out of stock as reason to refund.
But, using problem with buyers address won't affect your account.

The seller just picked the wrong reason, should have been “buyer’s request” after all he offered a choice which you did not want, so effectively you asked to cancel order.
Hardly crime of the century, problems with address, is frequently used, what seller was avoiding was giving the reason as out of stock, which gets seller a defect.

No problem & thank you for your advice. I don't think I worded it very well as my concern was listing items as authentic but not actually having them to sell.

Unless you receive item, you won't know if genuine item or not.
Sounds like you avoided issue of getting fake item.

Apparently the fake ' Jelly cat' toys were one of the biggest seizures, money wise, in British ports by Customs last year!
The price of yours would give you a good clue if it was a fake or not, the real ones have a very high price tag, doubt they would be sold cheaply on eBay !
