Return an item that wasn't sent on time - sender refusing refund but sent after requested not to

Please can you advise how I can arrange a refund for an item that wasn't sent on time.  I bought something for my husband's birthday on 2 August which said it would be delivered on 7 August.  The provided a tracking number on 5 August so I expected it to be delivered in time but then on 8 August I realised it wouldn't.  I submitted a complaint saying my item hadn't been delivered but at that point still wanted it in case it could be delivered.   There was no response for three days so I bought the item from another location and messaged the seller to say I no longer wanted it to be sent.  The continued to send it anyway and now are refusing the refund the item.  Please can you advise what I can do?

Late delivery means you can open a NOT AS DESCRIBED RETURN and seller has to orovideca return label.

However if it has not yet arrived you cannot open a case until you have something to send back.

 

If you have already  opened a case, then you only get one chance, so need to follow it through. If it is a business seller they have to accept returns, but the type of return determines who pays the return postage.
