Good morning

 

my daughter purchased a Labubu toy to see what all the hype was. She didn’t understand the hype  and decided she would sell it. She marketed it on here as ‘genuine Labubu’. The buyer has revived the toy and informs me it is not genuine and also that we are awful people! I have explained this is a genuine mistake, we have never bought one before and he can send it straight back to me for a full refund. He has then replied saying that’s not good enough! He wants to keep this ‘offensive fake’ and have half his money back. My daughter is then out of pocket and already upset she was duped in the first place. I don’t like confrontation, but feel what the buyer is asking is quite naughty. Should insist he sends it back for the full refund?

Partial refunds this is what the buyer is asking for cannot be enforced,  it's entirely up to you and the buyer.

 

If you do not agree , you can politely quote eBay's rules that the item has to be sent back for a full refund,  they need to open the relevant case for this, you do not refund until the item is back with you,  you do have to pay for that fully tracked return postage.

 

You may receive bad feedback either way, however,  there are feedback rules to follow if they mention anything about a fake,  a case,  refund,  or any eBay involvement  you can ask eBay to remove it.

 

Where was the item originally purchased?  If not from a genuine retailer,  high street shop, then yes there are many fakes around,  but purchase price is often a clue to authenticity.

Thank you so much for your response. I don’t like being spoken to the way
this chap has (especially when it’s aimed at my 11 year old child!) My
husband has asked for the buyer to call him to explain, but I may just go
back and explain the rules as he doesn’t seem to have the understanding
we’ve been duped too and wouldn’t ever sell anything ‘fake’ knowingly. As
far as I am aware it’s genuine, but I’ve never purchased one before, it’s a
small toy, I didn’t know you would even get fakes in something so silly!
I’m clearly very out the Labubu loop!

Yep, certainly no need for rudeness, but please do not let hubby get into any verbal or otherwise method of conversation with this person.  They are clearly upset at receiving a fake,  but as said,  no excuse for rudeness.

 

Whenever there's a fad on toys , fakes quickly follow , prices are always indicators for the real McCoy!

 

A polite message back apologising for the item,  and  that you too were duped,  but to please follow eBay rules to open the relevant case, return the item ( at your expense) for a full refund.

As buyers now pay eBay, not the seller, all returns and refunds need to be made through eBay.

 

To initiate this process, your buyer needs to open a case under eBay's money back guarantee. You accept the return, and if you want the item back eBay will enable you to send the buyer a prepaid return abel.

 

You will have the option, if you wish, to agree to a partial refund - or you can insist on a full refund on return.

 

Maybe it will be a useful lesson for your daughter that buying from unknown sellers on eBay is not like buying from the shops. There are fakes and scams everywhere. eBay even warns buyers that "they do not guarantee the existence, quality, safety or legality of items advertised, or the truth or accuracy of descriptions". Buyers are supposed to have read this in the user agreement, and understand the risks they are taking. eBay is a jungle.
