Recent warning for Defamation

Recently i was warned for Defamation by Ebay when i messaged a seller and stated the goods they supplied were counterfeit, however for the private message to be defamatory, it would need to be shared with a 3rd party, which it was not, therefore the message is not defamatory.

Further more, when i left negative feedback, the seller requested that i revise the comment i left "item reported to manufacturers fraud site." implying i was lying.

Feedback is public, so by saying counterfeit, anyone can see it.

It is also also against ebay policy to say that word.

Just keep feedback short & basic, that way it will be OK.

it was not feedback, it was a private message between me and the seller,
not public. and i have opened a fraudulent item case with the manufacturer

Is the seller also the manufacturer? 

If you are within 30 days of buying, open item not as described case and return for full refund.

This guarantees a refund.

Ebay won't get involved with manufacturer report you make.
