You'll need to open a return because the tracking will negate a "not received" case. So start a return on here:

select "Doesn't match description" and if necessary escalate it to eBay after 3 complete working days.
The seller may want the packaging back to support a claim for compensation from the courier. If so seller supplies a paid-for postage label. Or they may refund without return.

You need to use eBay's money back guarantee, but you MUST give give the reason as "item does not match the description".
If you say you didn't receive it eBay will check the postal tracking, which will confirm that it was delivered. eBay will then dismiss your claim - even though all you received was the empty package.

Open a not as described dispute by going to the item on you Purchase history.
The seller should send a label and you send the package back.
Once they have it back then they should refund in full
If they dont then escalate the dispute after 4 days and ebay will step in.
If the seller says they will send a replacement tell them you want a refund as replacements often do not arrive,
Was the packaged damaged in any way?

Open that Item Not as Described case.... Does Not Match Description or Photos. If this has happened to others as you say, and they too have opened those cases, the large number of cases for the same reason, too many refunds, and this will be a red flag to eBay and they may act with selling sanctions.
