I bought this phone in January. I accept that the phone may be repackaged but it is advertised as new, and the seller describes himself as "based in the UK" so I assumed that it would function as a UK phone. 6 months later I have discovered that it was actually manufactured in the USA. As such it does not support data roaming. The seller will not offer a refund because I am out of time for a return. I would argue that it is not fit for my purpose, and I would not have bought it had I known. I have been refused a refund because I should have read paragraph 22 of the T&Cs, where it states the phones are from a variety of different countries! In my opinion the seller's page is misleading and I am entitled to my money back. When I checked the page just now there is a note to say it has been altered by the seller; in addition, the page relating to my specific order is frozen and cannot be navigated

You cannot report this to eBay as they do not offer warranties or guarantees on items, just that they are just as described on receipt.  If they are not,  a buyer has 30 days under eBay's 30 day MBG,  Money Back Guarantee policy,  to return the item for a full refund.

 

If you bought this from a Private seller you are too late to claim a refund.  You could try your payment provider, you may just be in time to try a claim there.

 

If purchased from a registered UK business, who offered a guarantee and is now not upholding this,  then turn to Citizens Advice for your next steps,  if you wish to take this further.
