I bought a brand new phone on eBay which has issues.  I've taken the phone to Apple who confirmed there is a hardware fault.

 

I tried to open a dispute and the seller has closed it.

 

Any recommendations would be greatly appreciated.

If you have had the phone for more than 30 days, the seller doesn't have to accept a return.

You have to be prompt to use the Money Back Guarantee.

See if your payment provider can help as you have bought an item online which is not as described.

It would help us so much if when asking questions to say when and how you paid. eBay's time limits are precise to the day, sometime even to the hour and minute!

 

Anyway, the short answer is that if it was delivered within the last 30 days it shoud still have been covered by eBay's money back guarantee, unless you made some mistake when claiming. Any longer and eBay will have no further involvement. Any responsibiliy would rest with the seller. 

 

Whether Apple can help will depend upon the terms of the warranty. Unfortunately, manufacturers' warranties are often invalid for even supposedly new items bought on eBay.

 

eBay did warn you in the user agreement that they don't guarantee that items sold here will be truthfully described, safe or even legal. Something to think about perhaps the next time you buy a phone.

 

Depending upon how you paid you may still be able to get a refund through your payment provider, e.g. credit or debit card.
