I recently sold a Nvidia RTX Geforce 3080ti graphics card in perfect working condition
The buyer claimed it did not work and wanted me to accept the returns label asap
Ebay asked me to try and solve this issue via messages first
I did this and the buyer refused any help
I noticed the buyer had just opened a new account 2 weeks prior to purchasing my item
Oh dear this looks like a scam
Ebay accepted the return as I would not
I tried to worn Ebay this was a scam
Ebay said I have 2 days to inspect the item when it returns to me.
The item returned today
OMG it was not a large box with my graphics card but a small envelope with a stationary note pad inside.
As soon as the postman left I received an email from Ebay saying
We can see the item has arrived so we have refunded the buyer.
Ebay told me the day before I get 2 days to inspect
Obviously someone from Ebay was telling porkies
So there you go
I have lost £440 and my graphics card
Advice for Ebay
Do not give scammers the chance to buy Ebay Money Back Guarantee
They should have at least 6 months account and good history/feedback.
I hope people read this so they do not fall for this scam as well.
I have removed all my items now from Ebay but are unable to close down my account.
I presume it takes a while
I have attached a picture apparently of my graphics card

Before you appeal, report the buyer to Action Fraud.
You will get a reference number which you can add to your appeal and this adds to your credibility by showing you have taken this further and made an official complaint.

You are right, you should have been given time to refund but this might only happen if you issue the return label voluntarily.
Perhaps once ebay takes over that's it for seller control over the process. That might also impact your appeal.
Sellers should always engage with return cases whatever their views about legitimacy. This means agreeing and issuing a label.
