Buyer has informed me that he received the parcel 'tampered with' and the item has been stolen from inside the packaging, He has asked to return the item(which will be an empty box). Surely there must be some type of insurance my end or Ebay buyer protection on his side? I haven't accepted the return. I have messaged Evri but they are no help. Is there anything i can do or do i have to send a full refund and lose £40?

Was it sent using Simple Delivery? It makes a big difference.
If it wasn't then you have to refund.

Ebay should have taken over the case immediately, it should not be up to you to do anything and there is a risk ebay will refund with your money if you leave it until tomorrow.
I would get back to them and ask why they are not giving you Simple Delivery seller protection.
What reason did the buyer give for the case as that might be the issue. They needed to choose damaged in transit.

Can you see what it says for the reason for the return?
If the buyer is returning the item for not as described, that is.... Item Does Not Match Description or Photos, then you are responsible for the refund, have to accept the case within 3 days and issue a tracked return label if you want the item back, or refund now.
If using Simple Delivery and the return states damaged in transit, eBay should take over this case, and refund, and here, you get to keep the payout.
Depends on the reason stated for the return, and if Simple Delivery was involved.
