Bought a new phone. Arrived with box open. Security tags broken. Sold as a brand new phone? Con

Hi I've bought a brand new phone as advertised.

It arrived today .

 

Security tags on the box , opened both ends.

 

Is this a new phone? 

 

It's second hand surely? 

 

The seller claims it's new but says " customs opened it , "  but there is no customs paperwork or anything saying they opened it.

 

When I contacted the seller he said " what do you want a partial refund"  then he said he sent a new phone but was offering money back.

 

I've been ripped off

As you bought this through a private listing all information on the seller is concealed; we can't even see their username or what country they are in. Neither can we see the item description.

 

It's not impossible that If it was opened and checked by customs, but as you say I would have expected a note to be enclosed if they had broken the security tabs.

 

Provided it was definitely listed as new and unopened I imagine you will win an item not as described case under eBay's money back guarantee. The seller's responds sounds like China. Where was the item located? If abroad, you will probably have to return it abroad - in theory the seller should still pay for thereturn postage. If any problems about this, ask here again for what to do.

Depending on where it came from could be checks on batteries hence why opened if not labelled correctly to the outside? Possible scenario as to why tabs opened on box.

 

However you would have surely noted straight away as the outer packaging would show signs of damage/opening and carriers usually sticker or stamp parcels to outside to say checked/opened etc.

 

SO when the parcel arrived had the outer packaging been tampered with or opened in anyway?
