If you've started a return you will be able to escalate it 3 working days after you started it and ebay will enforce the supply of a return label from the seller.
So after 3 working days go to the return case via the link on the ebay message or in Resolution Centre, click on Case Details > Respond to Case > Escalate This Case > Submit.
