refund for defective article

I bought some brand new walking trousers in May from an ebay shop. Because they were new I didn't examine them too closely. I had to keep them until lockdown was lifted and I could book a walking holiday. I went on the holiday last week with the trousers and found that there was a repair behind the right leg meaning they couldn't have been brand new.  I contacted the seller and gave all the details. He was very helpful and we agreed that I would return them for a refund upon my return. So yesterday I did just that. This morning I received the curt reply 'The return period has expired for it.' . I couldn't believe it. He had all the dates and details from the start. He has now closed the case, what do I do? Sheila
