getting a rufund on item not received

I baught a battery from a Chinese firm on September 1st It diddnt arrive by October 7th so I opened a complaint I have now been told by ebay that I have to wait until Novenber 6th before I can do anything more.

This is rediculous.

I cant order onother from a local supplier if Im not going to get my money back aand I dont need to end up with 2 batteries.

Ive purchased batteries from China before and had no problems. they are exactly the same as those purchased locally.

My point was that Having ordered the battery... waited 3 weeks for it to arrive, then another week at the sellers request then opening a complaint. ebay now says I have to wait another month before anything can be done.
