ebay refusing to help my chase seller refusing to offer refund

I inadvertantly cancelled a return process, not knowing this would cancel my case with the seller. Upon contacting customer services, and nearly an hour of talk/hold I was ultimately told that ebay will not help me correct this - or allow me to open a new case against the seller.

Basically, I ordered an item of clothing (dressing gown for hospital stay) of size 4xl (I am -2xl so wanted roomy fit) - what arrived was so small I can hardly get it around my shoulders. 

the seller initially offer a laughable 40% refund (yes, dodgy chinese co), then raised to 60% - why should i take a loss on something not my fault?

ebay cs told me that ebay will not help - is this right? - and if it is - what censures do they use on sellers that break the rules?

Why did you close your return case? 

Chinese sellers are renown for offering discounts to keep the item, you just have to keep refusing and eventually you escalate your case and ebay will then step in. 

In my experience ebay will refund you at this point, but it is a while since I purchased anything from China, in fact I wouldn't buy from China at all these days.

I don't know if ebay still do this, or whether they have sme other solution in place, but once you've closed a case you can't reopen it.

If you paid through Paypal you can open a case there but you will have to pay the P&P yourself unless you sign up to 'Returns on us' first.

I'm afraid that if you close a case by mistake eBay does not allow you to open a second one.

 

If you bought this from a UK registered business seller, as an online purchase you still have a statutory right to return it for a full refund.

 

If you bought it from a seller in China, you may have to take a loss. UK consumer protection laws don't apply to sellers in China.

 

Otherwise, if the item is not the size stated you could consider using Paypal's buyer protection policy, but they might require you to return the item to China if that's where it was located. When things go wrong, importing items on eBay from sellers in China is not like buying in the High Street!
