buyer abusing ebay moneyback guarantee

A buyer has abused the ebay money back guarantee claiming an item was listed not as described even though it was listed in line with ebay policies.

I asked ebay to step in and ebay have decided in favour of the buyer. I was selling a remote control and some of the buttons were not working. I stated this in the listing as well as stating this when I sent the invoice yet ebay sided with the buyer. My confidence in ebay as a seller is gone!

Whatever you may think when a buyer opens a not as described case you must accept it and do the refund.  EBay has no way to establish the truth and always finds for the buyer

It's harsh we know.

This is ridiculous!

You listed the item clearly as for parts or not working. EBay's own definition of this in the listing is "For parts or not working: An item that does not function as intended or is not fully operational. This includes items that are defective in ways that render them difficult to use, items that require service or repair, or items missing essential components".

Plus, your description specifically stated that the buttons were not working.

You should definitely appeal this decision, see this extract from eBay's money back guarantee policy:

Appeals

When eBay decides the outcome of a transaction issue, the buyer or seller may submit an appeal within 30 calendar days of eBay's decision. As part of reviewing an appeal, we may ask the buyer or seller to provide additional documentation.

You can read eBay's full policy here: http://pages.ebay.co.uk/help/policies/money-back-guarantee.html

This is yet another example of how eBay so routinely finds in the buyer's favour that they hardly even seem to bother to look at the facts. If this was PayPal, you could have taken this decision to the financial ombudsman. But eBay is unregulated, with members having no right of appeal to any independent authority.

If the buyer reports the false positive you left your comment will be removed and it will damage your account more than the neg they left.
