After purchasing some nike air max trainers yesterday the seller informed me that they will be a week late posting and that they are actually not genuine nikes as advertised but replicas, he did agree to cancel order but then later messaged me saying he was not able to and whether I could which of course I can't. I need the funds back so I can purchase some genuine nikes.
You have a very foolish seller. He could easily have cancelled the sale, and saved both of you a great deal of hassle.
You will now have to wait until the item arrives - or doesn't arrive - and open a case under eBay's money back guarantee through the resolution centre. Be careful to open the correct case: not received, if it doesn't arrive by the latest estimated delivery date, or not as described if it arrives but is counterfeit. Do NOT open an ordinary return request, which the seller could refuse.
EBay will require the seller to send you a prepaid return label if they want the item back. They will handle the full refund process, so don't get drawn into negotiations with the seller.
Be sure to leave appropriate feedback, but don't mention the eBay case - this isn't allowed, and would entitle the seller to have your feedback removed.
adding to the advice already given -
contact eBay and refer them to the messages and ask them to action a cancellation and refund on the grounds the seller has admitted to violating eBay rules and the law by admitting to selling fakes.
Point out to eBay they are now fully aware of this criminal activity on their site.
