Seller requests cancel return

I purchased an item and a part of the item was broken In transit, the seller did not pack the item properly but did put fragile tape all way round the package.
I opened a return for a refund with photos and now seller is saying cancel return keep item and I can refund.
My question is obvious, can I be refunded by the seller now before I give up my right for eBay to mediate Or do I have to cancel request first?

Seller refunded without me closing the case, from this I take it the case automatically ends when the seller refunds.

Seller can select to refund without return on the case.  Do not close the case.  If seller does not refund you will not be able to reopen it.
