Seller not verified paypal account

I need help (excuse me for my poor english), what do I need to do to get my money back. The Seller sells without verified paypal account on ebay.
I got the item at auction. With payment via PayPal through eBay site were issues.
After that, the seller canceled order. Then gave me his paypal address, i paid ,the money was send, but the seller did not receive it, status-Unclaimed (it's not my fault).
Can't open the case, can't cancel payment, cannot refund by PayPal. 10 days have passed, nothing happens.

I quote the seller: " My PayPal is linked to an old email address which I have no access to, PayPal need to to confirm an email to accept your payment which I cant , so will have to relist on Ebay"

When I asked when he would solve the problem he said he couldn't.

You can't cancel the payment because its gone to a valid PayPal account but it's the seller's first payment in a different currency to the one his account is in. 

Your seller would need to accept the payment then refund you if he wasn't going to post the item to you - you should suggest that, but as he says he doesn't have access to that account its unlikely to happen.

You can't open a dispute because the item is paid for but the payment has not cleared and sellers aren't expected to post items until the payment has cleared.

If your seller doesn't accept the payment within 30 days of you sending it, it'll be automatically returned to you on the 31st day. If they accept it any time between now and then you'll be able to open a dispute. You'll know because the payment status will change.

Paypal support says have you tried this, that..

Cant open dispute, got a message "sorry we are not able to process your request" , cancel option present but no confirm cancel button, no refund option.

The Seller admitted that he had given me the old PayPal address, does nothing to approve the payment. The seller continued to operate the business.

The fact after two days research is "I have to wait 30 days"

If the account is an old account then the seller will not be able to access it
They could have contacted paypal and asked them to see if they could sort it out for them.
Too late now
If the money has not been claimed then yes, you will have to wait until the 30 days are up and it should be returned to you.

Did you take note that you are on the UK site and are in Bosnia and Herzegovina

The further sad reality is often, when someone has an ''old'' PayPal account that they can't access they mean, they have an old PayPal account they don't want to access or has been restricted.

There are plenty of PayPal restrictions that would allow an account to receive funds but wouldn't allow the seller access to them.

So yep, unless the seller actually has a legitimate reason for abandoning his old PayPal account (doesn't sound likely) then you'll have to wait.

The fact that you're in Bosnia and Herzegovina is only relevant in so far as it means the payment required acceptance. Had you been sending it to an account that was abandoned but in the same currency the payment would have gone in and you could have raised an INR on PayPal as soon as the seller notified you of the issue.

Are you sure there is no option to cancel the payment.

Have you tried opening the not received dispute on paypal?.

What does it say on your paypal account 

If it says unclaimed then it should come back to you after one month.

Are you on the correct site should you be on ebay.com.

That may make a difference. Just guessing

I am not sure what they can do but you could contact paypal and ask them about it.

You dont have to apoligize about your English. Certainly not poor and if you had not said I would not have known.

As @ redwick1 advises and as Based in Bosnia and Herzegovina with a Germany registered account, all cases/claims should be addressed through the German ebay.de site.

You can't open any sort of dispute against a payment that hasn't completed.
