Seller not paying what he agreed for

Hi can anyone help please. 

Seller agreed to pay half of the money for a defective item but its been 3 weeks he still hasn't paid keep messaging him but he's keep saying I will but never did.

As long as you are within 30 days of delivery open a Not as Described case,seller can make partial refund or return for full refund.

If no solution after 3 days escalate to eBay for return label and full refund.

Do not leave it too late so the transaction runs out of time to claim.
