Seller has received payment but refuses um send item

No one can force seller to post.  Either he will refund, or you will have to open a not received case and if still no refund escalate to ebay afte 3 days.

Bear in mind that refunds go back to source and for example creit cards take up to 30 days.

AFTER you have a refund leave NEGATIVE feedback just saying "Seller woud not honour the sale", Mark down thestars aswell.

Thank you - the seller acknowledged he'd received payment (but said he couldn't see how much!?) then suggested we transact outside of eBay - I refused then went to PayPal and requested a refund so eBay closed out my dispute - think I've kinda stuffed up there - but have sent negative feedback with warning for others - been using eBay for years first bad transaction
