Returned item, No refund, possible scammer, need help !!!

Hi guys, so i purchased an iphone 5 from eBay, arrived very very late in the post after seller kept making excuses for not posting, phone was completely dead so wanted refund, so returned item but didn't print postage label, just wrote address on box, so i sent the phone and to weeks later still no response so i asked have you received the phone yet, the only response i got to that was do you have the tracking number (which i didn't), straight away i knew why the seller was asking this, so they can claim they never received the phone meaning no refund,

so im asking, does the eBay money back guarantee still cover me if the seller wont pay?

found out seller has listed same phone with same pics and details a month later so ebay has to get me my money back right, think its a scammer?
