Three of my current listings have today been taken off as counterfeit. These are DVD-R's of films that I thought were out of copyright. If I am wrong, fair cop, it was a genuine mistake, but I find that identical items are also being sold by another seller. I am not a vindictive person, but I feel that if I am not able to sell these specific items on 'ebay' then nobody else should be able to do so either.
I have already phoned 'ebay' about this, but not surprisingly it has left open some unanswered questions. They being, does 'ebay' do random tests with such things, and was I just unlikely to get picked on. Also is there a definite demarkation line in law to determine when a film is in or out of copyright, or are there grey areas? and if so would 'ebay' be aware of such areas? I couldn't get any positive answers to my questions. The advisor I spoke to was helpful and tried to assure me that I had not been singled out, but despite this I can't see 'ebay' having the resources to do a complete sweep of everyone selling DVD'Rs to work out which one's are legitmate to sell!
It would be interesting to know fromf other sellers who have had similar experiences!
