Partial refund

Received message which wasn't as described and with a fault seller offered partial refund which I accepted. 
I then received a message from eBay that the refund had been sent that I didn't need to send the item back and i could keep it. 
as it wasn't suitable I've binned the item. 
seller contacted me this morning to confirm I will be sending the item back and if not they have been in touch with eBay to open a civil case and that they can request my address to take legal proceedings 

please advise

Why did you accept a artial refund when you should have gone for a full refund? Throwing in the Bin after accepting a part refund seems to contardict hat it was rubbish.

 

However only if the seller had given a FULL refund could he expect an item back, partial refund means you were still the owner.

 

You don't say how much is involved, but in my opinion the seller is talking a lot of Hot Air. He has no right to the item so what action does he think he can take.
