Offensive Seller

I bought what i thought was a game on a CD. It turned out to be a piece of paper with a download code on it.

The advert says it is new in an unopened sealed package.

Further down it does say it is a CLD or whatever.

It also says no returns or refunds

The advert seems pretty misleading to me, and i asked E-Bay about the return which i was told i could do.

At first, the seller blamed E-Bay for putting the part where it says new in a seal package.

I pointed out the rules and the law.

From there the insults accusations from the seller became worse and worse.

I now started to believe a frau had taken place.

I went onto the Sony site and discoverd these download codes were on sale some time ago in America. For a lot less than they were on sale on E-Bay by this seller.

The advert made it clear these are not for resale.

I contacted Sony who are investigating

I contacted a family member who is a Policeman. He encourages me to make a complaint to the Police

I have recieved a message from the seller who tells me has recieved the return, but claims to have contacted Sony and the code has been used. Which i most certainly have not done.

I cannot find a way of informing E-Bay of how the saga has developed, nor am I able to progress the return further than the return has been posted

The seller has not informed E-Bay

Any suggestions on what to do next?

It does not matter what the seller says

It is not clear if you opened the not as described dispute or not

You open the dispute and escalate it after another 8 days

If the seller is in the UK you get a returns label to return the item

Once the seller has the item back then ebay will force a refund

I think you are saying you have returned it. Put the tracking into the dispute

If you did not send it tracked then there is nothing you can do

No returns means nothing if the item is not as described
