If seller is a TRADER AND ONE CAN TELL IF THEY SELL LOTS OF THINGS, ALWAYS - SURELY CONSUMMER RIGHTS COME INTO PLAY. (SEE TAX MAN HAS COTTONED ON TO THIS NOW - SO SHOULD EBAY CHANGE NO RETURN POLICY ON PEOPLE WHO SELL CONTINUINGLY).

If the top is too small for you that doesn't make it not as described (unless you bought a size 10 and the label size says 16, for example).
So, if your seller is a registered UK business (and it doesn't matter if you've decided that they are a trader, it's what it says on their eBay listings that count), you can ask for a return as a change of mind, as is your right.
However, if they are a private seller they do not have to accept a return because a top is too small.
If you believe that they truly are trading as an unregistered business, report them to HMRC.
However, if it's the seller you've left a negative for, there is no indication whatsoever that they're a business, and you've trashed their feedback rather unfairly, I feel..
