Item not in good condition

The item I received is not in good condition. The item was obviously strategically placed to enhance the photos...ie to hide staining/marks. The owner suggested I return for a refund and as soon as I said ok she started giving her opinion of me and has not processed a refund. Do I just wait for eBay to make a decision?

If you have opened a case for item not as described,  it gives the seller  3 days to refund you,  if they do not you must escalate on day 4 and before 30 days.  Then,  the case times out,  closes,  no refund.

So escalate on day 4,  and eBay will step in and fully refund you.
