Item never received, Riyal mail agreed lost, no refund off seller

I ordered an item that showed delivery by Royal Mail. However, it was never received. After contacting Royal Mail they confirmed that it was not delivered to me but instead incorrectly delivered. I was given a claim reference that had to go to the seller, as they had posted the item, for them to claim the refund. I have since had no response from the seller to my numerous emails apart from an automated 'the item has been delivered'. I do not have it or a refund. Apparently my order is not covered under the eBay guarantee, no idea why.

do I just accept the lost money and give up? I don't know where to go from here.

The sad situation is that if a RM item is tracked [or scanned at doorstep] as delivered [even to the wrong address] then eBay regards the case as closed.  I'd be surprised if RM "knew" that an item was "misdelivered".   

 

I have difficulties with the concept as wouldn't 90% of us if we get something like that simply give it back to postie or return it to seller [if return address shown].  I wouldn't want random stuff delivered to my house hanging around!

Where did you read your item is not covered by eBay's 30 day MBG ?  From the seller?  Then they are lying.  Only digitally sold items  and vehicles are not covered,  so doubt Royal Mail is involved here!

 

Just open that case for item not received in the Resolution Centre,  escalate on day 4 if not refunded beforehand.

Do not close the case early on any exuse or promise from the seller,  and do not forget to escalate.

 

Any claim references is for the seller to chase up for their compensation,  you just open that case and escalate on day 4.
