Item lost by global shipping

I know I am not the first to have this experience, I'm just wondering if anyone has managed to resolve it.

 

Item sold through GSP

Item sent

Item arrived at GSP Centre 4th May (Lichfield)

Item left GSP Centre 5th May

Arrived in destination country 6th May
Cleared customs.
Last week customer opens case as item hasnt arrived. 
I provide tracking information showing package arrived and left Lichfield.

Ebay refund buyer and take money from me.

Disputed it and they tell me tracking is invalid. This is their tracking.

Opened a chat with customer service and they refuse to discuss it, in fact they cut me off.

It is my understanding that this applies:

You aren't responsible for item loss or damage that occurs after the item is forwarded by the UK Shipping Centre. Once an item has been forwarded by the UK Shipping Centre, you won't be responsible for refunding the buyer if an eBay Money Back Guarantee or PayPal Buyer Protection case is filed against you for one of the following reasons:

  • A buyer claims an item isn't received or

  • A package is damaged in transit

"

and as this is the terms and conditions of the GSP program which ebay set and it is legally binding?

Get on to eBay and appeal/ifght.

 

The usual advice given is -

 

You need to be extremely careful how you handle this as you could be seriously out of pocket if you try to handle this yourself.

 

Your buyer needs to open a case for not received and you respond with the tracking number proving delivery to the UK Global shipping hub.

 

You cite that according to Global T&C you, the seller, are not responsible for any loss or damage in transit once it has arrived at the Global hub.

 

You should have passed the buck to GSP in the first place.

 

Did you not add tracking to the item when you marked as dispatched? Adding after a case is opened and you can as has happened lose. 

 

Why ever use this risky service, deal direct with buyers. If an item fails to arrive then you claim on Royal Mail.
